Service: kids51.com Version: DRAFT v0.1 — 14 October 2026 — not yet in force Effective date: [EFFECTIVE DATE]
These Terms are a contract between you and Dzmitry Pliachko, a sole proprietor registered in the Polish Central Register of Business Activity (CEIDG), NIP 8992909337, REGON 520256406, ul. Stanisława Drabika 63/19, 52-131 Wrocław (“we”, “us”). They apply to the kids51.com website, the installable web app and any future mobile apps (the “Service”).
Please read Section 6 (Subscriptions, automatic renewal, cancellation and refunds) carefully. The paid plan renews automatically until you cancel.
1. Who may use the Service
1.1 Accounts are for adults only. You must be at least 18 years old (or the age of majority where you live) and the parent or legal guardian of any child for whom you create a profile.
1.2 Children may use the Service only (a) on our public game pages without an account, or (b) through a child profile created and controlled by a parent. You are responsible for your children’s use of the Service through your account.
1.3 Teachers and schools may use classroom features only under our separate Teacher & School Terms, which will apply in addition to these Terms when those features launch.
2. Your account
2.1 We sign you in with a one-time link sent to your email address. Keep access to your email secure; anyone who can read your email can sign in to your account.
2.2 You can create up to 4 child profiles. A profile contains only a nickname, an avatar from our set and an optional age band. Do not enter your child’s full name or any contact information as a nickname.
2.3 You may link your child’s devices to a profile with a pairing code. A linked device can open only the children’s area, not your account or billing.
2.4 Information about how we handle personal information, including children’s information and parental consent, is in our Privacy Policy, which forms part of these Terms.
3. The Service
3.1 kids51.com provides learning games (starting with times tables), printable worksheets and, later, additional features such as spelling practice, chore and routine charts and teacher class codes. Features may be added, changed or retired over time. We will not remove a core feature of the paid plan during a period you have already paid for without offering a pro-rata refund for the remainder of that period.
3.2 Free and paid features. Some features are free. Others require the paid Family Plus plan. [TO CONFIRM: list of free vs Family Plus features, as shown on the pricing page.]
3.3 No advertising. The Service currently contains no advertising. The children’s area will never contain advertising.
3.4 Educational purpose. The Service supports practice at home and in class. It is not a substitute for teaching, tutoring, or professional educational, psychological or medical advice, and we do not promise any particular learning result. Routine and chore charts are general organizing tools, not health or parenting advice.
3.5 Availability. We work to keep the Service available but do not guarantee uninterrupted access. We may suspend the Service temporarily for maintenance or security.
4. Acceptable use
You agree not to: (a) use the Service in violation of law; (b) try to access accounts or data that are not yours; (c) interfere with, overload, scan or reverse-engineer the Service except as allowed by law; (d) use bots or scrapers to copy content at scale; (e) enter personal information about a child other than what a profile asks for; (f) resell or commercially redistribute the Service or our content; (g) use the Service to harm or exploit children.
5. Content and licenses
5.1 Our content. The games, audio, printables, designs, text and software are owned by us or our licensors and protected by intellectual-property law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your family’s non-commercial use.
5.2 Printables. You may print and copy our printable worksheets and charts for use with your own children and, if you are a teacher, with your own students, free of charge. You may not sell them, republish them online, or remove our branding. [TO CONFIRM: printable license scope — e.g., whether tutors/homeschool co-ops are allowed.]
5.3 Your content. Content you create (for example, word lists or charts) stays yours. You give us a limited license to store, process and display it only to provide the Service to you. We do not use it for any other purpose.
5.4 Feedback. If you send us suggestions, we may use them without obligation to you.
6. Subscriptions, automatic renewal, cancellation and refunds
6.1 Plans and prices. Family Plus covers one family (up to 4 child profiles) and costs USD 5.99 per month or USD 39 per year. Prices exclude applicable sales tax or VAT, which is calculated at checkout based on your billing address and shown before you pay.
6.2 Free trial. New families can try Family Plus free for 7 days. No payment card is needed for the trial. When the trial ends, your account returns to the free features unless you choose to subscribe; you are never charged automatically at the end of the trial. One free trial per family (per parent email address).
6.3 Payment. Payments are processed by Stripe on its hosted checkout page. By subscribing, you authorize us (through Stripe) to charge your payment method the price shown plus tax at the start of each billing period. If you subscribe during your free trial, your first charge happens when the trial ends; you keep the remaining trial days.
6.4 Automatic renewal. Your subscription renews automatically at the end of each billing period (every month or every year) at the then-current price plus tax, and your payment method will be charged, until you cancel. You agree to this when you subscribe; we show these terms next to the subscribe button and send you a confirmation by email.
6.5 Renewal reminders. We email you 7 days before every renewal of a monthly or annual plan. For annual plans we also email you [TO CONFIRM — required: 30] days before renewal. Each reminder states the amount, the date, and a direct link to cancel.
6.6 How to cancel. You can cancel at any time in your parent dashboard (Billing → Cancel subscription → Confirm: two clicks), or by emailing hello@kids51.com from your account email address. No call, chat or survey is required. Cancellation takes effect at the end of the current paid period; you keep Family Plus until then and are not charged again.
6.7 Refunds. You can ask for a full refund of any charge within 14 days after it was made — with the “Refund” button in your dashboard or by emailing hello@kids51.com. When we refund a charge, your subscription ends immediately and your account returns to the free features. After 14 days, charges are not refundable, except where required by law or under Section 3.1. Refunds go back to the original payment method; your bank may take several days to show them.
6.8 Price changes. We may change prices for future periods. We will email you at least 7 and no more than 30 days before a new price applies to you, with instructions to cancel. The new price applies only from your next renewal after that notice.
6.9 Failed payments. If a renewal payment fails, Stripe may retry it. If payment is not made, your account returns to the free features. [TO CONFIRM: retry schedule / grace period configured in Stripe.]
6.10 Mobile app purchases (future). If you subscribe inside an iOS or Android app, the purchase, renewal, cancellation and refunds are handled by Apple or Google under their terms, and you manage it in your Apple or Google account settings. Section 6.7 then applies only to the extent Apple or Google allow us to issue refunds.
7. Ending the relationship
7.1 You can stop using the Service and delete your account at any time from the dashboard. Deleting your account cancels any subscription immediately (request a refund under 6.7 first if you are eligible) and deletes your data as described in the Privacy Policy.
7.2 We may suspend or close an account that seriously or repeatedly breaches these Terms, or where required by law. Except in cases of fraud, abuse or legal requirement, we will tell you first and give you a chance to fix the issue. If we close your account without cause, we will refund the unused part of your current paid period.
7.3 We may discontinue the Service entirely with at least 30 days’ email notice and a pro-rata refund of any prepaid period.
8. Disclaimers
TO THE EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. Some jurisdictions do not allow the exclusion of implied warranties, so some of this may not apply to you.
9. Limitation of liability
9.1 TO THE EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
9.2 TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD USD 50.
9.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for intentional misconduct, or any liability that cannot be limited under applicable law, including mandatory consumer protection law.
10. Indemnity
If you use the Service in breach of these Terms or the law and that causes a third-party claim against us, you agree to cover our reasonable costs of that claim, to the extent permitted by applicable consumer law.
11. Consumers — your statutory rights
11.1 Nothing in these Terms takes away rights you have as a consumer under the mandatory laws of the place where you live.
11.2 EU/EEA and UK consumers. You have a statutory right to withdraw from a distance contract within 14 days. Because the paid plan starts immediately when you subscribe, you ask us to start performance during that period; our 14-day refund in Section 6.7 gives you at least the same result as withdrawal. [TO CONFIRM with EU consumer-law review: checkout acknowledgement wording for digital services.]
12. Disputes and governing law
12.1 Talk to us first. Most problems can be solved quickly. Before starting any formal claim, please email hello@kids51.com with a description of the issue; we will try to resolve it within 30 days.
12.2 Governing law. These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules. If you are a consumer, this choice does not deprive you of the protection of the mandatory laws of the country or U.S. state where you live. [TO CONFIRM — decision recorded in NOTES.md]
12.3 Where disputes are heard. You may bring a claim in the courts of your place of residence, including any small-claims court, or in the courts of Wrocław, Poland. We will bring claims against a consumer only in the courts of the consumer’s place of residence.
12.4 EU online dispute resolution. [TO CONFIRM: the EU ODR platform was closed in July 2025 — remove this clause unless a replacement obligation applies.]
13. Changes to these Terms
13.1 We may update these Terms, for example when we add features or when the law changes. We will post the new version with its effective date.
13.2 For material changes that affect your rights or payments, we will email you at least 30 days before they take effect. If you do not agree, you can cancel before the change takes effect; if you cancel because of a material change, we will refund the unused part of any prepaid annual period. If you continue to use the Service after the effective date, the updated Terms apply.
13.3 Changes required by law or made for security reasons may take effect sooner; we will still tell you.
13.4 Changes to how we collect or use children’s information are handled under the Privacy Policy and require new parental consent.
14. General
14.1 These Terms, the Privacy Policy and the Subscription, Refund & Cancellation Policy are the entire agreement between you and us about the Service. 14.2 If any part of these Terms is unenforceable, the rest stays in effect. 14.3 Our failure to enforce a right is not a waiver. 14.4 You may not transfer your account or these Terms. We may transfer them to a successor in a merger or sale of our business, with notice to you; your rights under these Terms and the Privacy Policy continue. 14.5 We are not responsible for delays caused by events beyond our reasonable control. 14.6 These Terms are written in English. [TO CONFIRM: if a Polish version is published, which prevails for Polish consumers.]
